EULA - End User License Agreement

ANAHATA SOFTWARE LICENSE AGREEMENT. NOTICE: Anahata Software's AtamA program is for information and study purposes only and is not meant to replace the need for medical care. Users are encouraged to seek out the best medical resources available so that well-informed decisions can be made. This is a legal agreement between you and Anahata Software. Carefully read all the terms and conditions of this agreement prior to installing the software. Installation of Anahata Software's AtamA program and associated files ("the software") indicates your acceptance of these terms and conditions. If you do not agree to these terms and conditions, do not install the software. Non-licensed users are granted a limited license to use the software on a trial basis for the purpose of determining whether they wish to purchase the software. If you are a non-licensed user, you must agree to the terms of liability limitation as stated in section 5 below. 1. License: This License Agreement grants the purchaser one license to use one copy of the software on any single computer. You may not transmit the software from one computer to another in a network or to serve multiple users. 2. Transfer: You may transfer the license to another party if the other party agrees to the terms and conditions of this agreement and registers ownership of the software with Anahata Software. If you transfer the license, you must also transfer or destroy all copies of the software in any form, including the original and backup copies. You have no right to sublicense or loan the software. 3. Copyright: The copyright for the software is owned by Anahata Software and is protected by United States and international copyright laws and international treaty provisions, as set forth in Title 17 of the United States Legal Code and elsewhere. 4. Term: This license is effective until terminated. This license and your right to use the software will terminate automatically if you violate any part of this agreement. You agree upon termination to return or destroy within 5 days all copies of the software and to affirm in writing to Anahata Software that you have done so. 5. Limited Warranty (Disclaimer and Limitation of Liability): If the software has been provided to you on a CD, Anahata Software warrants the CD to be free from defects in materials and workmanship at the time of delivery to you. Anahata Software has made reasonable checks of the software to confirm that it will perform in normal use on compatible equipment substantially as described in Anahata Software specifications for the software, as published most recently prior to the delivery of the software to you. However, due to the inherently complex nature of computer software, Anahata Software does not warrant that the software is completely error free, will operate without interruption, is compatible with all equipment and software configurations, or will otherwise meet your needs. Accordingly, the software is provided as-is, and you assume all risks associated with its use. As your sole remedy for any breach of warranty, you may present proof of purchase and return to Anahata Software the complete CD package and any backup copies if the software was provided to you on a CD. At Anahata Software's discretion, the software will be replaced or you will be refunded the amount you paid for the software, provided the return is completed within 90 days of delivery to you of the software. Anahata Software makes no other warranties expressed or implied, with respect to the software and any accompanying material, their merchantability, or their fitness for any particular purpose. All warranties, express or implied, will terminate upon the expiration of 90 days following the delivery to you of the software. Some states do not allow limitations on how long an implied warranty lasts, so the above limitation may not apply to you. In no event will Anahata Software be liable for indirect, incidental or consequential damages, including, without limitations, loss of income, use, or information, nor shall the liability of Anahata Software exceed the amount paid for the software package. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you. This warranty gives you specific legal rights, and you may also have others which vary from state to state. 6. General: This agreement constitutes the entire agreement between you and Anahata Software and supersedes any prior written or oral agreement concerning the software. Anahata Software is not bound by any actions or statements of its independent distributors, nor by any provision of any purchase order, receipt, acceptance, confirmation, correspondence, or otherwise, unless Anahata Software specifically agrees to the provision in writing. 7. Export: Distribution of the software is subject to compliance with all laws, regulations, orders, and other restrictions on export from the United States of America of the software or any technical information about the software which are imposed by the government of the United States of America. 8.
